These Terms and Conditions govern the use of the Surf Up Surf School website and the booking and participation in surf lessons and related activities. By accessing our website or booking a lesson, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our website or services.
1. About Us
Surf Up Surf School (“we”, “us”, “our”) provides surf lessons and related services in Polzeath, Cornwall.

2. Bookings
All bookings are subject to availability and confirmation by us. A booking is not confirmed until payment has been received or we have confirmed acceptance of your booking in writing. We reserve the right to refuse or cancel bookings at our discretion.
3. Payments
All prices are shown in GBP and include VAT where applicable unless stated otherwise. Payment must be made in full at the time of booking unless otherwise agreed. Payments are processed securely through third-party payment providers. We do not store payment card details.
4. Cancellations and Refunds
If you need to cancel or reschedule a lesson, you must notify us as soon as possible.
Cancellations made more than 48 hours before the scheduled lesson may be eligible for a refund or reschedule, subject to availability.
Cancellations made within 48 hours of the lesson may not be refunded.
No refunds will be given for non-attendance.
We reserve the right to cancel or reschedule lessons due to weather conditions, sea conditions, safety concerns, instructor illness, or other circumstances beyond our control. In such cases, we will offer an alternative date or a refund.
5. Weather and Sea Conditions
Surfing is dependent on natural conditions. Lesson content, duration, and location may change based on weather, tides, and sea state. No refunds will be issued due to subjective dissatisfaction with surf conditions where lessons are deemed safe to proceed.
6. Health, Safety and Fitness
By booking a lesson, you confirm that you are physically fit, able to swim, and do not suffer from any medical condition that would make surfing unsafe without first informing us.
You must follow all safety instructions given by instructors at all times.
We reserve the right to refuse participation if we believe a participant poses a risk to themselves or others.
7. Children and Minors
Participants under the age of 18 must have permission from a parent or legal guardian. A parent or guardian may be required to sign a consent form before participation.
8. Equipment
All equipment provided remains the property of Surf Up Surf School and must be used responsibly. You may be liable for loss or damage caused by misuse or negligence.
9. Assumption of Risk
Surfing is an inherently hazardous activity. By participating in our lessons, you acknowledge and accept the risks involved, including injury caused by waves, surfboards, other participants, or environmental conditions.
10. Liability
To the fullest extent permitted by law, Surf Up Surf School shall not be liable for any loss, injury, damage, or death suffered while participating in our activities, except where caused by our negligence or breach of legal duty.
We are not responsible for loss or damage to personal belongings brought to lessons.
11. Photography and Media
We may take photographs or videos during lessons for promotional purposes. If you do not wish to appear in any media, you must inform us in advance.
12. Website Use
You agree not to misuse this website or attempt to gain unauthorised access to it. All content on this website, including text and images, is owned by or licensed to Surf Up Surf School and may not be copied or reused without permission.
13. Privacy
Personal data is handled in accordance with our Privacy Policy, which is available on our website.
14. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon publication on our website.
15. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
